In-home Christmas Family Photo Sessions
Terms and Conditions
Bookings and payment:
Full payment of the session fee is required to confirm the booking. The session fee payment is non-refundable, unless the photographer is unable to perform the requirements of this contract due to inclement weather, illness or other circumstances, in which case the full amount paid will be refunded. The prices offered for the In-Home Christmas Sessions are valid for the 2024 Christmas season, excluding 25 December, 26 December and 1 January.
The Photo session:
The photo session will be held at the client's home, and may be indoors or outdoors as requested by the client. The photo session will be of 30 minutes duration. Additional time may be necessary to set up and pack down portable studio lighting equipment. Set up and pack down time is additional to the photo session time, and incurs no additional cost to the client.
Rescheduling due to adverse weather:
The client understands that adverse weather conditions may require an outdoor photo session to be rescheduled to an alternative time or date, at no additional cost. In the event that no alternative date or time can be arranged prior to 22 December 2024, the session fee will be refunded in full.
Image proof gallery:
Following the photoshoot, the photographer will release a gallery of at least 6 image proofs by way of a private online gallery. The images will be edited and ready for selection and/or purchase, however the image gallery is solely for the purpose of viewing and selection. The images will be watermarked, and are not to be downloaded, screen-shot or reproduced in any form, and doing so may result in legal proceedings for breach of copyright.

Image orders:
The client will select three images to receive in high resolution jpeg format. The client may, if they wish, purchase additional images for $25.00 each. Payment for additional images is due at the time of order placement. The selected and purchased digital images will be sent to the client without any watermarks or logo, by way of file transfer within 24 hours of the payment being received and cleared.
The photographer guarantees to retain the images from the photoshoot on file and available for additional orders for a minimum period of six months.

Copyright and Use of Image Permissions:
The photographer retains all intellectual property rights in the digital images, including the sole copyright to the digital images. Nothing in this Agreement shall operate to transfer, assign or otherwise grant any party any right or interest in the photographer's intellectual property rights or affect ownership by the photographer of intellectual property rights with regard to the digital images.
The client may not alter the images in any way.

The client may use the digital images for personal, non-commercial use only, and subject to the restrictions set out in this Agreement. Personal, non-commercial use means the client may display the digital images on their personal computers and may print the digital images for personal use. The client may also share the images via social media platforms.

The client shall not use, and shall not allow to be used, the digital images in an obscene, defamatory or immoral way.
The client shall not use, and shall not allow to be used, the digital images for any purposes prohibited by the laws of Australia.
The client shall not resell, sub-licence or redistribute the digital images except as provided for in this Agreement.

The client shall not falsely represent that they are the original creator of the digital images.

The digital images are produced on a colour calibrated monitor to ensure quality and colour accuracy. By purchasing the photo session package and digital images, the client acknowledges and understands that the colour and appearance may vary on other devices, and print quality and colour accuracy will depend on the quality of the printing service used.

The client grants the photographer unrestricted and irrevocable right and permission to use any photographic images taken as part of the photographer's engagement on the photographer's website, and in other social and marketing media forms including but not limited to Facebook, Instagram and physical promotional materials.
